Hotels move against Booking.com following key EU Court ruling
Hotel associations across the EU, led by HOTREC, are preparing coordinated legal action against Booking.com following a landmark ECJ ruling. The judgment rejects the argument that narrow parity clauses — which prevent hotels from offering better prices on their own websites — qualify as ancillary restraints under Article 101(1) TFEU. The ECJ clarified that such clauses are not essential to the existence or functioning of the platform, marking a turning point in the competition law treatment of digital platforms.
